Terms of Service — Barberio

1. Acceptance of Terms

By downloading, installing, or using the Barberio mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Barberio.

2. Description of Service

Barberio is a barbershop booking platform that connects clients with barbers and barbershop owners. The App allows clients to discover barbershops, book appointments, leave reviews, and manage their booking history. Barbers can manage their schedules, view client appointments, and track their performance. Shop owners can manage their business operations, team, and services. Barberio acts as an intermediary platform and is not a party to any agreement between clients and barbershops.

3. User Accounts

You must create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during the registration process. You agree to update your information promptly if it changes. We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

4. Bookings and Cancellations

Appointments booked through the App are subject to the barbershop's availability and cancellation policies. Barberio facilitates the booking process but is not responsible for the quality of services provided by barbershops. Barberio is not liable for disputes between clients and barbershops regarding services, pricing, or scheduling. Repeated no-shows or last-minute cancellations may result in temporary or permanent restrictions on your booking privileges.

5. User Conduct

You agree not to: use the App for any unlawful or unauthorized purpose; harass, abuse, threaten, or intimidate other users; post false, misleading, or defamatory reviews; attempt to gain unauthorized access to other users' accounts or the App's systems; interfere with or disrupt the proper functioning of the App; use automated means (bots, scrapers) to access the App; or impersonate any person or entity.

6. Intellectual Property

All content, design, logos, trademarks, and features of Barberio are the exclusive property of Barberio and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of any part of the App without prior written consent from Barberio. User-generated content (such as reviews and profile photos) remains your property, but you grant Barberio a non-exclusive license to use, display, and distribute such content within the App.

7. Limitation of Liability

Barberio is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure. Barberio is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to service interruptions, data loss, unauthorized access, or disputes between users. Our total aggregate liability shall not exceed the amount paid by you to Barberio, if any, in the twelve (12) months preceding the claim.

8. Termination

You may delete your account at any time through the App's settings. We reserve the right to suspend or terminate your account at our discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users or the App. Upon termination, your right to use the App ceases immediately, though certain provisions of these Terms will survive termination.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify users through the App or via email. Your continued use of the App after changes take effect constitutes your acceptance of the modified Terms. If you do not agree with the updated Terms, you should discontinue use of the App and delete your account.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Tunisia. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of Tunisia.
